No the law is 4 years maximum. There is only a 3 year difference, therefore he didn't break the law. At least that's the law in my state which is PA, here's a list of the laws per state:

Where were the adults to stop this from happening? I mean, really? There shouldn't be any excuses for someone like her. 16 year olds are not adults. They don't always think. 18 is pretty young too. Someone should have been involved here.

Yes he did break the law. She is under 18, any contact of a sexual nature is considered to be statuatory rape. Her boyfriend should be arrested and thrown in jail.

Yes. Statuatory rape is anyone over the age of 18 having sex with someone under the age of 18. He should legally be brought up on charges.

The laws regarding teen sex are some of the most ridiculous that can be seen.

Evidently they were made by someone with their head "where the moon doth shine".

While it works OK if you have a prosecutor that has some common sense, but if you get some idiot or moron prosecutor or judge, it can result in untold amounts of damage to all parties involved.

Unless someone wants to press charges, and if it is true that she was emancipated at the age of 16 and living with her boyfriend, then no, it isn't rape.

The only way he can go to jail is if her parents file charges on him and I don't think they are going to do that.
She is old enough to make her own mistakes. Yeah, she's 16 but she know what she's doing. She know's right from wrong.
