No, he is not. He is a new member. Was he a former leader, or will he overthrow Pein? I don't know, I'm guessing that he's strong enough to be leader, and has only recently joined because of his interest in Sauske.
Tobi is very strong. He is probably Madara Uchiha, founder of Uchiha clan. Pein performs his commands.

lol well it ain't a rumor, you can see in there in the manga that he reveals himself as madara uchicha and is giving orders to pein. so obviously he's got more power and skill then pein that he can boss him around
as pein said, if jiraiya knew his secret he would have defeated him, tobi probably knows it.he has called himself madara, and pain said he got orders from madara to zetsu, so he is almost definitely madara.
he probably joined akatsuki recently so he can keep an eye on how things are going from the inside, but he knew pein from before. or maybe he is just employing akatsuki and isnt really its leader? maybe that is why he is giving pein orders.
