Every once in a while if a large percentage of the comics from a print run are found to have a common printing error (like the pages falling out like you found) the publishing company will issue a recall of the comics and exchange them for new ones. That exact error happened in mid 2007 with one issue of either Incredible Hulk or World War Hulk, so Marvel did a second (still first print) print run/recall to replace them.

I think policies for refunds and replacements for isolated incidences are determined by the comic book store owners. I know the online comic store that I order from provides free replacements whenever I get an issue that is either damaged in transit or has a printing defect. I've had to have a few issues replaced because of both of these reasons and the store never gave me any crap about it. Also one of my local comic book stores has a sign that says all sales are final, no refunds, etc. The other store owner let me exchange one issue that I found a tear in after I purchased it, but that may have just been because I've spent lots of money there in the past.

It's because comic books degrade in price if it gets creased or folded. Reading the comic creates creases.

Next time, just check the staples first before buying it. ^_^

If you are a regular customer of a comic store, the owner usually doesn't have a problem with returning a comic. Though I haven't asked for a refund, I've asked to replace the comic with an undamaged one.

The owner of my regular comic store will refund a comic if he has recommended it and I don't like it.

All I can say is to ask the comic store. If returning comics is not a recurring thing, I wouldn't imagine them not helping in order to keep their customer happy.
