When people say "who would win batman or superman" do they mean who!
Question: Because there's no way batman could kill superman. Even if he did get superman near kryptonite it doesn't like kill him outright or anything.

Essentially, people are ostensively asking if the reader thinks Batman or Superman would win if they battled, although what they are asking is which of the two characters are more popular. Conceptually, I think Batman is a much more interestng character than Superman, but I have to agree with everything you've said (I also think Batman has been mucked over by various writers to the point where I can't stand how he's currently being depicted, but even if he were my favorite character I still wouldn't think he could possibly hope to defeat Superman). A real Batman fan will be so convinced that Batman is such a hard and driven individual that he could defeat anyone. Too many comics fans are obsessed with the concept of power, and don't care enough about character.
Superman is stronger and cooler. He killed a God. Darksied was the Hades of the DC Universe and Superman killed him, you just can't beat that.
But Batman would jump out of the way, just in time. Basically, I think Superman would be powerless when in the presence of the infinite coolness of Batman.

Superman would win, of course! and your "twrow-a-rock" technique is a very good idea... batman just knows... i don't know... some kind of martial arts, he uses powerful gadgets but he will never beat Kal-El's power, strength, speed and resistence. And others words: Superman is the coolest!!!
