Answers:
He had multiple offenses, a wrap-sheet a mile-long!. THEN he got busted for gambling, not to mention sleeping with a minor (which coincidentally was a complete ad-lib conversation Jack Nicholson had with the administrator of the mental facility)!.
McMurphy had the option of going to jail or claiming insanity, with possible release pending a "brief" stay at the hospital for observation purposes!.

Random fun fact: the older gentleman (the admin!.) of the hospital was actually the real admin!. of THAT mental hospital!. Fun huh!? Jack told him offscreen to just "go with it" then proceeded to try and throw curveballs at him by ad-libbing the script for the old chap!.Www@Enter-QA@Com

" One Flew Over the Cuckoo's Nest "

McMurphy, a man with several assault convictions to his name, finds himself in jail once again!. This time, the charge is statutory rape when it turns out that his girlfriend had lied about being eighteen, and was, in fact, fifteen (or, as McMurphy puts it, "fifteen going on thirty-five")!. Rather than spend his time in jail, he convinces the guards that he's crazy enough to need psychiatric care and is sent to a hospital!. He fits in frighteningly well, and his different point of view actually begins to cause some of the patients to progress!. Nurse Ratched becomes his personal cross to bear as his resistance to the hospital routine gets on her nerves!.Www@Enter-QA@Com

Randle Patrick McMurphy (Jack Nicholson), a recidivist criminal serving a short prison term on a work farm for statutory rape, is transferred to a mental institution due to his apparently deranged behavior!. This is possibly a deliberate gambit by McMurphy in the belief that he'll now be able to serve out the rest of his sentence in relative comfort and ease!.Www@Enter-QA@Com

He was not nutz ! He wanted to get out of work in prison, so he faked being a nut case!.

When he went to jail, he decided to pretend he was crazy so they'd send him to the hospital and he'd get a break from prison!.Www@Enter-QA@Com

McMurphy was going to prison, but pleaded insanity and got into the mental asylum!.Www@Enter-QA@Com
