In New York State, it is whichever the birth certificate says. Even if they are post op trangendered, the birth certificate stands. We actually have a he/she in right now. It is in with the men as that is the BC says it is.

Most hemaphrodites live and are considered one gender or the other at birth so it'd probably be that one.
a prison gaurd told me that herms get sent to male jails but they have thier own sector. away from everyone else, and no i have not been to jail, lol
I would imagine they would probably have special facilities for this sort of case. Isolation or something. I have heard of someone who was a transexual (male to female) being taken out of the mens prison and put in to a hospital prison so he could continue his transformation treatment at the same time and to protect him from bullying and abuse.
I imagine they would need to take this sort of action to protect a hermaphoridite also.... and have a solo facility for this person or something. Not sure though! Interesting!
Most of them would probably live and identify as one gender or another though by this point in their life, and is passable, go to the gender prison to which they identify.
