How would you respond to a 10 year old child who told you to shut up.?!
Question: When you told him that he couldn't climb the fence, especially when the dog was out doing his business. His parents will be here soon, no doubt. I told him to mind his manners and get back over the fence...he said he couldn't climb back over, stuck out his tongue and opened the gate...Holy crap, I'm stunned!

This kid is in a lot of emotional turmoil right now, he must have a lot of bad things going on in his life to act in such a manner. Getting mad (not that you're mad - you didn't really say) might help you vent, but it won't help in the long run. Unfortunately, this isn't a problem you're in a position to solve, unless you notice the child is coming from an abusive home. In that case you can call in a child abuse report. If you don't notice anything like that, then let the parents know how serious you are about keeping this child out of your yard; put it on them.
Edit: Looks like I was onto something. It seems that the child comes from a very chaotic home. You can see where he gets it from. You're not in an enviable position. YOU can't change the child's behavior and if the parents won't, then he's not going to change. If this sort of thing continues, my best advice for you is to keep a log with dates, times and incidents that happen with this family. Eventually, you can call the police out and you'll have everything recorded. They probably won't do too much, but it will show the family you're serious and can also help you get a restraining order (drastic measure, but you never know). Hopefully, it will never come to that.

I'd slam dunk his little *** into a corner for a considerable time out. 10 year olds do make the rules. You really have to set limits early.
Some parents prefer to have a blind over their eyes, refusing to acknowledge that their child has behavior issues. Really not much you can do. That is completely disrespectful of that child to have been like that towards you, but obviously, you know where he got it.
