Should people be able to patent ideas without producing any physical product?!

Question: Should people be able to patent ideas without producing any physical product!?
I mean patent trolls!. Like the guys who sued RIM, the inventors of the Blackberry!. The patent trolls put no effort into research and development, waiting for the first person to make wireless e-mail devices, so they could sue them and make money that way!.

I wonder if the makers of Star Trek can patent warp drives, teleporters, and holodecks!?Www@Enter-QA@Com

Most patents are granted without producing a working model!. The answer to your question is no, you couldn't patent a Star Trek transporter!. The plans are reviewed by scientists and engineers and have to have some realistic chance of working!.

You have to remember that the purpose of the Patent is to protect perhaps one proprietary design!. If two people patent similar concepts there is not much to argue about until there is a working model!. If someone beats you to the marketplace with a working model, that model probably has twenty other patents that makes the overall concept work!.

You can sue, but the court tends to go with the person or company who has the other patents that make the central design work!.

However, courts are funny and sometimes the little guy does win out!. Patent law is kind of like horse racing, it's usually best to bet your money on team that has an actual horse in the race and to bet your money on the fastest horse!. Regardless, the 20 to 1 shot occassionally does win a race!.Www@Enter-QA@Com

I think you should be able to patent ideas but be given a limited time frame with which to produce a working product based on your patented idea!. So that helps inventors from getting screwed by big business, but it also limits the ability of "patent trolls" as you call them from just getting a patent for any feasible idea and sitting on it in hopes someone will do it so they can sue!.Www@Enter-QA@Com

I think patent require more details than that!.

Patent is also about power!. I heard some patent in small country was make first, then USA company come up with same idea, patent in USA!. USA company sued the small company and win!.

RIM just unlucky don't register in USA first!. Www@Enter-QA@Com

No, well its the same concept as saying "I saw it first!." when the other person gets it first!. Most definetly you can patent the idea, but must have a concept in mind and drawn up!. Www@Enter-QA@Com

Depends on what the product is!.!.!.maybe there should be a law or something saying that you must be developing a physical product to patent the idea (even if your physical product is not working correctly)!. OMG Star Trek kicks ***!.Www@Enter-QA@Com

People should be able to patent any of their LEGIT ideas!. warp drives, teleporters and holodecks are NOT legit!.Www@Enter-QA@Com

It is called intellectual property!.Www@Enter-QA@Com
