Question: Is Sirius execs!. discriminating against XM listeners!?
Hi Y'all, How many of you who subscribe to XM radio find that the Sirius Execs have discriminated against us!. Eliminating our channels, shows and on air personalities!. They have the Howard Stern Show and Oprah on both systems!. They could have our music channels that way too!. And after a few months see which ones the people are listening to the most!.And do a follow up poll to see if the numbers are right!. Those DJs stay!. XM was the number one Satellite Radio!. Why should we be the ones to lose our channels!? Do any of you lawyers think there should be a class action suit against Sirius!?Www@Enter-QA@Com

You can't sue for discrimination, but there might be some other kind of legal theory you can sue for--maybe antitrust (i!.e!. argue XM Radio is trying to monopolize the internet radio market or something like that, but this doesn't seem likely)!. In order to have a case for discrimination, you have to prove you are a particular class of people who are being treated differently from other classes!. You're not going to be found to be a "class"--legal classes are generally based on things very intrinsic to one's identity such as race, sex, sexual orientation, class, religion, etc--and even if you were found to be a class you'd be would be subject to the judicial scrutiny that is most beneficial to Sirius!.Www@Enter-QA@Com
