All broadcasting in the United States is technically licensed, no matter if you use a cell phone or CB radio, it's licensed in some way!. also any radios used in communications are supposed to be checked and certified by the FCC to work within the limits imposed by this government agency (mainly to make sure the CB radio for instance doesn't interfere with the police radio for instance)

You have to get a FCC Amateur Radio License to use the frequencies allocated to this service by the FCC and international treaties!. The main reason why you have to test compared to just apply for a license like others, is the fact that Amateurs are allowed to build, modify, and operate their equipment!. No other service is allowed to build or modify their radios!. Hince the testing!.
